Please read these Terms of Service carefully before using the GoFoodz platform. By accessing or using our services, you agree to be bound by these terms. If you do not agree to these terms, please do not use our platform.

1. The Platform & Services

GoFoodz is an international food gifting platform that enables users ("Senders") to purchase food and beverage items from participating restaurants and food establishments ("Suppliers") and send them as gifts to recipients ("Recipients") in other countries via digital redemption codes.

Our platform facilitates the connection between Senders, Suppliers, and Recipients. GoFoodz acts as an intermediary and is not itself a food establishment or delivery service. The actual food and beverage products are provided by the Suppliers.

We reserve the right to modify, suspend, or discontinue any aspect of our platform at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the platform.

2. Accounts

To use certain features of our platform, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. GoFoodz will not be liable for any loss or damage arising from your failure to protect your account credentials.

You must be at least 18 years of age to create an account and use our platform. By creating an account, you represent and warrant that you meet this age requirement.

3. Purchases & Payments

All purchases made through our platform are subject to availability and confirmation. Prices are displayed in the applicable currency and include any applicable taxes unless otherwise stated.

Payment must be made at the time of purchase using one of the accepted payment methods. By providing payment information, you represent and warrant that you are authorised to use the designated payment method.

All sales are final unless otherwise required by applicable law or as expressly stated in our refund policy. In the event of a technical error or platform failure that prevents a valid redemption code from being delivered or used, we will work with you to provide a remedy, which may include a replacement code or refund at our discretion.

GoFoodz reserves the right to cancel any order that we believe, in our sole discretion, may be fraudulent or in violation of these Terms of Service.

4. Redemption Codes

Upon successful purchase, GoFoodz will generate a unique digital redemption code that can be shared with the intended Recipient. The Recipient may present this code at the participating Supplier location to redeem the purchased items.

Redemption codes are subject to the following conditions:

  • Codes are valid only at the specific Supplier for which they were purchased
  • Codes have an expiry date as specified at the time of purchase
  • Codes cannot be exchanged for cash or transferred to a different Supplier
  • Each code may only be redeemed once
  • GoFoodz is not responsible for lost, stolen, or unauthorised use of redemption codes once delivered

If a redemption code expires before use due to circumstances beyond the Recipient's control (such as Supplier closure), please contact our support team to discuss available options.

5. Supplier Obligations

Suppliers who register on the GoFoodz platform agree to honour all valid redemption codes presented by Recipients, subject to the terms agreed upon during the Supplier registration process.

Suppliers are responsible for the quality, safety, and accuracy of the food and beverage products they offer through our platform. Suppliers must comply with all applicable food safety regulations, health codes, and licensing requirements in their jurisdiction.

GoFoodz reserves the right to remove any Supplier from the platform at any time for failure to comply with these obligations or for any other reason at our sole discretion. Suppliers must notify GoFoodz promptly of any changes to their menu, pricing, operating hours, or availability that may affect outstanding redemption codes.

6. User Conduct & Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Using the platform for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempting to gain unauthorised access to any part of the platform or its related systems
  • Using automated tools, bots, or scripts to access or interact with the platform without our express written permission
  • Purchasing redemption codes for resale or commercial purposes without our prior written consent
  • Providing false or misleading information during registration or in connection with any transaction
  • Engaging in any fraudulent activity, including chargebacks without valid cause
  • Interfering with or disrupting the integrity or performance of the platform
  • Attempting to reverse engineer, decompile, or disassemble any portion of the platform
  • Harassing, threatening, or intimidating other users, Suppliers, or GoFoodz staff

7. Limitation of Liability & Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOFOODZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

GoFoodz is not responsible for the quality, safety, or availability of food and beverage products provided by Suppliers. Any disputes regarding the quality or fulfilment of products should be raised with the relevant Supplier in the first instance.

Our total liability to you for any claim arising out of or relating to these Terms of Service or your use of the platform shall not exceed the amount you paid to GoFoodz in the twelve (12) months preceding the claim.

8. Termination & Changes

We reserve the right to suspend or terminate your account and access to the platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform will immediately cease.

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the platform after any changes constitutes your acceptance of the revised terms.

If you wish to terminate your account, you may do so by contacting our support team. Termination of your account does not affect any rights or obligations that arose prior to termination, including any outstanding transactions or payments.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms of Service or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Jamaica. If you are accessing the platform from outside Jamaica, you are responsible for compliance with local laws to the extent they are applicable.
